Professional Consulting (Design Services) Contracts with architects / engineers

**REMINDER: Projects with an estimated value greater than $75 million must be referred to us in the Planning Phase.  The Architect may be required to insure against Professional (Errors and Omissions) Liability on a single Project basis.**

 

  • When the "design" is part of a Design-Build procurement:  Use the “CCDC 14 (2013) – Design-Build Stipulated Price Contract" Risk Provisions below

Design-Builder Insured – under $5 million

Owner Insured - $5 million to $75 million

When using the RAIC Doc 6: RAIC Doc 6 – 2022 Supplementary General Conditions

RAIC Doc 6 – 2022 Supplementary General Conditions have been provided for your convenience for the RAIC Canadian Standard Form of Contract for Architectural Services – Document Six – 2022 (Digital Version).  These Supplementary Conditions are designed to be used in their entirety.

When using the CCDC 31: CCDC 31 – 2020 – Supplementary General Conditions

CCDC 31 – 2020 – Supplementary General Conditions have been provided for your convenience for the CCDC 31 (2020) – Service Contract Between Owner and Consultant.  These Supplementary Conditions are designed to be used in their entirety.

 

If you want to use your own Supplementary Conditions for the RAIC 6 2022 or CCDC 31 2020:  Contact us and we can provide you with "Risk Provisions" which provide the required changes to the indemnity, insurance and limitation of liability language.​​​​

The indemnity being granted by the Owner in the above Supplementary Conditions (and in the related Risk Provisions) has received blanket indemnity approval.  A copy of the indemnity approval  letter (link to Blanket Indemnities webpage) is available.

If you will be using an alternative form of Prime Consultant contract:  Contact us and we can provide customized "Risk Provisions".  All custom indemnity clauses require indemnity approval in accordance with the Financial Administration Act.
